Social media today has become such an important part of life that we cannot imagine otherwise. Instagram, WhatsApp, Facebook, Dating Apps to name a few are places where we regularly share pictures, our triumphs or tragedies, professional or personal and we do this innocuously. However, like everything it has its pros, it also has its potential consequences.

Married couples have dozens of mutual friends, someone of who remain loyal to only one of the spouses. In such a case, any posts or messages which are uploaded online can be very problematic. For instance, the husband said that he did not have enough money to pay for the spousal support, but on his social media has uploaded pictures of his recent trip to Europe. It is a possibility that the husband and wife have un-followed each other during separation but their mutual friends could keep them updated about their spouse’s activities online. And if they don’t themselves post stuff on social media maybe their friends have posted pictures of how incredible the road trip was in her new car and the weekend getaway she sponsored. You see, this way things get very complicated during the contested divorce procedure in India.

In addition to social media, the texts or emails that in general people communicate through routinely can sometimes be subpoenaed and looked at very carefully for the financial affidavit — any references for an impending bonus or a new job offer are important.

So, it is important to not post anything personal, particularly about your separation, children or money or make any emotional disclosures, even about things that are unrelated to your divorce, since social media could provide useful information about the husband or wife particularly if what the spouse says in legal documents does not match with what she/ he posts online.
